
You land in Malaga with a two-year-old and the first question is: where does the car seat come from? Spanish law leaves you no choice. A child up to 135 cm tall travels in an approved child car seat. Without one, the police write out a €200 fine and take 4 points. For each child separately.
Booking a rental car with a child car seat in Malaga comes down to three options. Hire a seat with the car, bring your own on the plane or buy one locally. Each makes sense in a different situation, and over a week's holiday the price gap can reach a hundred euros. Below you will find the rules for 2026 and prices from the Car4Rent booking panel, the big airport brands and Carrefour. Plus what to check at pick-up before you strap your child in.

The legal basis is Article 117 of the “Reglamento General de Circulación” (Spain's general traffic regulations, RGC). There is one rule. A child up to and including 135 cm travels in an approved child seat, chosen for their height and weight. In Spanish it is an SRI, “sistema de retención infantil” (child restraint system). Age does not matter. Centimetres do.
The child seat goes on the back seat. The front is allowed in three situations only. The car has no rear seats, all rear seats are taken by other children in child seats, or not every seat fits in the back. A rear-facing seat in the front? Only with the passenger airbag switched off. No exceptions.
A separate rule covers taxis in urban traffic: a child may travel without a child seat, but only in the back. That does not apply to rental cars.
The fine is €200, or €100 if you pay within 20 days, plus 4 licence points. It has been 4 points since March 2022. Before that it was 3, which is why older guides disagree. The penalty is counted for each child separately. Police have the right to immobilise the car until you sort out a seat. On the MA-20 ring road on a Saturday evening? Not the scenario you want.
The DGT (Dirección General de Tráfico, Spain's traffic authority) does not let this one slide. In its March 2026 campaign officers checked 443,758 cars and found 458 children with no seat or badly strapped in. The rules you know from home are close to the Spanish ones, but not identical. The difference is in the detail.

What that means in practice: Spain has no age cut-off. A 12-year-old under 135 cm can ride without a booster in the UK, but in Spain they still need one. Coming from Ireland, it works the other way round. A child who is 140 cm tall still needs a booster at home and legally does not in Spain.
The DGT recommends a booster up to 150 cm anyway. A belt across the stomach and neck, instead of the hips and collarbone, does more harm than good in a crash. For €10 there is not much to think about.
The label on a child seat shows one of two approvals.
ECE R44/04 is the older standard. You choose the seat by the child's weight, in groups. The baby groups are 0 (0 to 10 kg) and 0+ (0 to 13 kg). Then come I (9 to 18 kg), II (15 to 25 kg) and III (22 to 36 kg).
R129, known as i-Size, is the newer one. You choose by height, a side-impact test is compulsory and the child rides rear-facing until at least 15 months. i-Size seats usually fit on ISOFIX anchor points, which have been compulsory in new cars in the EU since the end of 2014.
Since 1 September 2024 new R44 seats cannot be sold in the EU. You can still use one, with no end date. An R44/04 seat you bought a few years ago at home is just as legal in Spain as a new i-Size. Police check the approval label and the fit to the child, not the year of the standard.
The simplest route. At Car4Rent Malaga you add child seats in the “Extras and accessories” step of the online booking. The fee is one-off, however many days you rent:

Two children? Set the quantity to two and take two seats. Give us your child's weight and height when you book and we will pick the right model. The seat will be waiting in the car at pick-up, outside the airport terminal or at your hotel (hotel delivery is a paid extra).
Does the 0 to 18 kg or 15 to 36 kg seat have ISOFIX? Ask when you book, because it depends on the model available for your dates. The booster is held by the car's seat belt, without ISOFIX.
For comparison, the big brands at Malaga airport charge per day. Hertz asks €19.06 a day for an infant seat, capped at €114.34 per rental, and wants the seat booked 24 hours ahead. Europcar charges around €13 a day, up to about €90 per rental. Sixt, Avis and Goldcar work in a similar way, usually €60 to €115 for a week.
Airlines carry a child seat free of charge, though each has its own rules. Three you are likely to fly with from the UK or Ireland:
The upside: you know this seat, and so does your child. The downside: the hold. The seat travels unprotected and can come back with a cracked shell, and a damaged seat should not be used again. Then there is the weight. An i-Size seat for 40 to 150 cm weighs 10 to 15 kg. You lug it through the airport along with the suitcases and a child. A backless booster is a different league. It fits in your hand luggage.
Going for this option? Pack the seat in a cover or plastic wrap and look it over carefully as soon as you land.
Carrefour, Decathlon and El Corte Inglés stock child seats all year round. Prices from Carrefour.es, correct as of September 2026:
It makes sense if you are staying for longer, come back to the Costa del Sol every year or need a new seat anyway. For a week's holiday it is overkill. You pay several times more than the rental fee and then carry your purchase home.
